GENERAL TERMS AND CONDITIONS BENNI RAICH RACE CENTRE
- All contracts concluded with the Benni Raich Race Center (hereinafter referred to as the ‘Organiser’), Oberleins 9, 6471 Arzl im Pitztal, are based exclusively on these General Terms and Conditions in the version valid at the time of registration. Individual written agreements take precedence over these terms and conditions. By registering for a Race Centre Camp, the participant or his/her legal representatives agree to have read and fully understood these General Terms and Conditions and are deemed to have accepted them.
- The current camp rules apply during participation in the Race Centre Camps, which are available at LINK. Failure to comply with the camp rules may result in exclusion from the camp. In such a case, there will be no refund of training, lift or hotel costs. In the case of underage participants, the legal representatives will also be informed and must arrange for the immediate collection of the participant at their own expense.
- The participant further undertakes to comply with the relevant rules of behaviour in skiing (in particular the FIS rules) during participation in the camp.
- It is pointed out that there are risks in the camp due to the ski training and other activities carried out as part of the camp programme, which cannot be prevented even by the greatest possible care on the part of the organiser, whereby the organiser is only liable for gross negligence. Participation in the Race Centre Camps is therefore at the participant’s own risk.
- The participant must take out appropriate insurance (liability insurance, accident insurance and the like) to cover the risks and dangers generally associated with skiing and other activities carried out as part of the camp programme. the participant confirms or the legal representatives confirm that they have taken out valid insurance as described above for the duration of the camp stay. Furthermore, it is confirmed with the registration that the participant is physically and athletically healthy and fully resilient.
6 Race Center Camps are planned by the organiser on a long-term basis. It may therefore be necessary to make changes (programme, training discipline, training area, camp accommodation, etc.). A change to the programme does not entitle the participant to terminate or withdraw from the contract.
- There is no entitlement to supervision by a specific trainer. The organiser will always endeavour to provide a replacement trainer if a trainer is unavailable. A change of trainer does not entitle the participant to cancel or withdraw from the contract. The organiser is not liable for failure to achieve a certain level of training and teaching success.
- The participant is aware that both video and audio recordings will be made during the camp stay for educational purposes. The participant or his/her legal representatives give their consent at this point that these may be used free of charge for the organiser’s advertising purposes (publication on the organiser’s homepage, Facebook, etc.).
- The organiser is not liable for loss, theft or damage to items brought to the camp. The costs for damage to the property of the camp accommodation or items owned by the organiser, which can be proven to be due to the behaviour of a participant, are to be borne by the participant or their legal representatives regardless of fault. No liability is accepted for damage caused by third parties.
- If a registration for a Race Center Camp is cancelled, the training, lift or hotel costs will be refunded by means of a credit note.
- The organiser may cancel a camp before the planned start or end a camp early in the following cases in particular: – If the minimum number of participants is not reached: A camp will only take place if a minimum number of participants is reached. If the number of registrations is insufficient, the organiser may cancel the camp up to ten days before the start at the latest; – in exceptional circumstances: If the implementation of a camp is made more difficult, endangered or impaired due to extraordinary circumstances (war, strike, unrest, etc.) that could not be foreseen at the time the contract was concluded, or if the training is cancelled for reasons beyond the organiser’s control (bad weather, wind, lifts closed due to weather conditions, etc.), the organiser may cancel a camp or end it early without being bound to a deadline. In such cases, the training, lift or hotel costs will be refunded in the form of a credit note. Any further claims of any kind (travel and/or accommodation costs, other (additional) costs as well as compensation payments for loss of working hours, etc.) are excluded.
- It is agreed that Austrian law shall apply exclusively to any disputes, with the exception of those reference norms that lead to the application of foreign law, and that the court in Innsbruck, Austria, shall have jurisdiction.
